Electronic receipt: how to avoid data loss and penalties

Like what has already happened with payments via POS, the electronic receipt and the telematic transmission of transactions have now become an obligation for every retail business, a means, chosen by the legislator, to counter tax evasion and digitize checks otherwise too expensive. An obligation that came into force, after trials and extensions, on 1 January 2022 and which has highlighted some serious problems for retailers in these first 15 months of operation.

Since the storage and telematic transmission of the daily fees is an obligation, any violation (including the occasional sending of incomplete or incorrect data) is punished with a fine equal to 90% of the tax evaded. Even in the case of correct payment of the tax (i.e. of a merely formal violation) a fine of a fixed value must still be paid for each incorrect transmission. If the threshold of four violations is exceeded in the last 5 years, the commercial operation could be hit by heavy penalties which include the suspension of the license for a period ranging from three days to six months, depending on the total value of the amounts.

With the electronic receipt, the fiscal honesty of the operator does not disregard the need to use highly reliable cash register, registration, and transmission systems, capable of coping with adverse situations, including stop (which happened) of the reception services managed by the Revenue Agency. The 90% fine on the amounts also applies when the fault of the irregular transmission depends on the malfunctioning of the network or the cash register. Failure to request assistance or failing to periodically check the recorder is punished with fines ranging from 250 to 2,000 euros and which rise to 1,000-4,000 euros if the electronic recorder has not been installed.
